FACE TWEAK FACE ALTERATION TERMS Facial Alteration and Depicted-Person Addendum Version 1.0 Effective Date: August 5, 2026 IMPORTANT - SEPARATE AFFIRMATIVE ACCEPTANCE REQUIRED FACE TWEAK CAN MATERIALLY CHANGE WHAT A REAL PERSON APPEARS TO BE DOING, FEELING, EXPRESSING, OR PERFORMING. OUTPUT MAY APPEAR AUTHENTIC. YOU, NOT PIXERATI LLC, SELECT THE MEDIA, DIRECT THE ALTERATION, AND DECIDE WHETHER, WHERE, AND HOW TO USE THE RESULT. DO NOT USE FACE TWEAK TO ALTER A REAL PERSON'S FACE UNLESS YOU HAVE THE SPECIFIC, WRITTEN AUTHORIZATION AND ALL OTHER RIGHTS REQUIRED FOR THE ALTERATION AND ITS INTENDED USE. CONSENT TO RECORD, CONSENT TO ALTER, AND CONSENT TO DISTRIBUTE AN ALTERED DEPICTION ARE DISTINCT PERMISSIONS. NEVER USE FACE TWEAK TO ALTER THE FACE OF A MINOR OR OF A PERSON YOU KNOW OR REASONABLY SHOULD SUSPECT MAY BE A MINOR. PARENTAL OR GUARDIAN CONSENT DOES NOT CREATE AN EXCEPTION. NEVER USE FACE TWEAK TO CREATE OR FACILITATE AN INTIMATE, NUDE, SEXUALLY EXPLICIT, OR SEXUALLY SUGGESTIVE DEPICTION OF A REAL PERSON. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT SELECT THE ACCEPTANCE CHECKBOX AND DO NOT USE FACE TWEAK TO PERFORM A FACE ALTERATION. 1. INCORPORATION, DEFINITIONS, AND ACCEPTANCE 1.1 Incorporated Terms. These Face Tweak Face Alteration Terms (the "Face Terms") supplement and are incorporated into the Face Tweak End User License Agreement, Version 1.0 (the "EULA"). Capitalized terms not defined here have the meanings given in the EULA. Sections 5 through 10 and 14 through 16 of the EULA are incorporated into these Face Terms. If these Face Terms directly conflict with the EULA, these Face Terms control solely with respect to a Face Alteration, Depicted Person, prohibited use, or media-specific responsibility; the EULA controls otherwise. Applicable third-party licenses continue to control solely for their materials as stated in the EULA. 1.2 Separate Acceptance. In addition to accepting the EULA, User must affirmatively select the separate checkbox stating that User has read and agrees to these Face Terms whenever that checkbox is presented during installation, activation, first use, or an updated acceptance flow. Merely viewing these Face Terms or continuing past an informational screen does not by itself satisfy this separate-acceptance requirement. Until the required separate acceptance has occurred, User is not licensed under the Pixerati distribution to perform a Face Alteration. 1.3 Authority. An individual accepting these Face Terms for an organization represents that the individual has actual authority to bind the organization. An installer administrator's acceptance does not certify that the administrator or organization holds rights for any particular media or Depicted Person. Each required media-specific certification remains a separate obligation. 2. ACKNOWLEDGMENTS User acknowledges and agrees that: (a) a person who consented to be filmed or photographed did not thereby consent to alteration of that person's face, expression, emotional performance, movement, gaze, or head position; (b) a Face Alteration may be difficult for a viewer to distinguish from unaltered media and may affect rights of publicity, personality, privacy, digital-replica and performer rights, collective-bargaining obligations, copyright and other rights in the underlying media, and laws governing deceptive, intimate, or synthetic media; (c) rights, consent requirements, disclosure duties, and synthetic-media laws vary by jurisdiction and may change; and (d) Pixerati does not know what media User will select, does not grant rights in any person's identity or performance, and does not verify age, consent, authority, collective-bargaining compliance, or legality. 3. REQUIRED RIGHTS AND MEDIA-SPECIFIC REPRESENTATIONS Before each Face Alteration, and again after any material change to the User Media, alteration, intended context, purpose, audience, distribution, territory, Required Authorization, or applicable agreement, User represents and warrants that: (a) each person whose face will be altered was not a Minor as defined in EULA Section 7.1 when the applicable media was captured, and User has reliable, documented grounds for that determination; (b) User has obtained legally valid, informed, specific, unambiguous, voluntary, and written Required Authorization from every Depicted Person whose face will be altered, or from another person with actual legal authority as permitted by EULA Section 6.2; (c) the Required Authorization expressly covers the nature and material extent of the Face Alteration and its intended context, purpose, media, audience, commercial use, manner of distribution, territory, and duration; (d) User owns or has licensed every copyright and other right in the User Media needed to load, alter, process, store, use, and distribute it and the resulting Output; (e) if a collective bargaining, union, guild, performer, employment, or production agreement applies, every notice, consultation, bargaining, specific-consent, reuse, compensation, security, retention, deletion, or other act required from an employer, producer, signatory, union, guild, performer, or other party has been completed when due and will be timely completed while the obligation continues; and (f) no law, court order, rights withdrawal, contract, or other restriction known or reasonably discoverable by User prohibits the Face Alteration or intended use. 4. ABSOLUTE AND PROHIBITED USES User must not use the Software or Output to: (a) perform, create, request, possess, process, reproduce, or distribute a Face Alteration of a Minor or of a person User knows or reasonably should suspect may be a Minor, regardless of purported parental, guardian, or other consent; (b) create or facilitate an intimate, nude, sexually explicit, or sexually suggestive depiction of any real person, whether or not identifiable and regardless of purported consent; (c) depict a real person as saying, endorsing, doing, feeling, expressing, or performing something the person did not say, endorse, do, feel, express, or perform in a manner intended or reasonably likely to mislead a viewer about authenticity, authorization, or endorsement; (d) create or facilitate fraud, identity theft, deceptive impersonation, extortion, blackmail, stalking, harassment, threats, defamation, false light, evidence fabrication, obstruction of justice, unlawful surveillance, biometric-authentication circumvention, or unlawful election interference; (e) alter news, documentary, journalistic, evidentiary, law-enforcement, or legal-proceeding media in a manner that materially misrepresents the recorded event, evidence, testimony, or a person's actual conduct or performance; (f) violate a person's intellectual-property, privacy, publicity, personality, digital-replica, performer, labor, biometric, data-protection, confidentiality, contractual, or other rights; or (g) violate any law, court order, platform rule, or binding production, talent, union, guild, client, or distribution agreement. 5. DISCLOSURE, RECORDS, AND CERTIFICATION 5.1 Disclosure. User must clearly and timely disclose that media has been artificially generated or manipulated whenever required by law, platform rule, contract, professional standard, or the context needed to avoid materially misleading viewers. User must preserve any legally or contractually required watermark, content credential, provenance record, or other authenticity indicator. 5.2 Authorization Records. User must maintain adequate records of Required Authorization and applicable collective-bargaining compliance for the periods required by EULA Section 6.6. User must not falsify, improperly alter, or prematurely destroy those records, and must securely delete them when a law, governing agreement, or lawful retention schedule requires deletion. 5.3 In-Application Certification. If Face Tweak presents a media-specific rights-certification checkbox, User must answer personally or through an authorized representative, truthfully, and on the basis of actual knowledge or a reasonable documented inquiry. That certification is User's representation concerning the identified media, alteration, and intended use. It is not Pixerati's verification, approval, legal advice, or clearance and does not replace any consent or act required from a Depicted Person, employer, producer, union, guild, or other party. 5.4 No Circumvention. User must not bypass, disable, suppress, falsify, interfere with, or automate past an acceptance or certification control, and must not improperly alter or prematurely delete a record that the Software lawfully creates. 6. RESPONSIBILITY AND RISK ALLOCATION User selects the User Media, directs each Face Alteration, decides whether to accept the Output, and controls every downstream use. To the fullest extent permitted by law, User is solely responsible for the User Media, Required Authorization, rights and collective-bargaining clearances, age determination, human review, legally required disclosures, production decisions, and every creation, possession, storage, publication, transmission, exhibition, and distribution of Output by or for User. User's indemnity obligations in EULA Section 16 apply to these Face Terms and to claims arising from User's Face Alterations and Output. Nothing in these Face Terms transfers liability that applicable law does not permit to be transferred or excuses Pixerati from its own conduct. 7. NO LEGAL ADVICE These Face Terms and any in-application prompt are not legal advice and do not list every law, agreement, clearance, or disclosure that may apply. User should consult qualified counsel and, where applicable, the production's legal and labor-relations advisors and errors-and-omissions insurer or broker before performing or distributing a Face Alteration. SEPARATE ACCEPTANCE I HAVE READ AND AGREE TO THE FACE TWEAK FACE ALTERATION TERMS. I UNDERSTAND THAT I, NOT PIXERATI, AM RESPONSIBLE FOR OBTAINING AND DOCUMENTING ALL REQUIRED AUTHORIZATION AND FOR EVERY FACE ALTERATION AND DOWNSTREAM USE, SUBJECT TO THE LIMITS OF APPLICABLE LAW.
